Due to the death of a sixteen-year old fan, there has been a rash of lawsuits that stemmed and is not looking like they will end anytime soon.
Jessica Michalik was crushed in Limp Bizkit's Big Day Out festival performance in Sydney after the crowd began to rush the stage.
In response to her death, the Michalik family filed various wrongful death lawsuits against the promotors, the security company and the band, Limp Bizkit.
However, the lawsuit against the band (and parties connected with them) were quickly dismissed by the New South Wales Court, as the court found them not liable.
In a turn, however, the insurance company responsible for providing the band their insurance, United National Insurance Company, has filed a lawsuit against the Limp Bizkit.
The insurance company believes that Fred Durst, the frontman for the band, encouraged the crowd to “rush the stage”; the company believes that this action of encouraging the crowd to react was not under their policy.
The insurance company also claims that they did not agree to cover that particular concert in Sydney beforehand.
In response, Limp Bizkit's attorney, Ed McPherson, has claimed that both the New South Wales court and the coronor's inquest have disconnected the band from being liable for Michalik's death.
McPherson also states that the insurance company assured them that the Sydney concert was fully covered but since the incident, the company has been very unresponsive to their questioning.
The insurance company hopes to resolve the issue through the courts to show that Limp Bizkit is responsible and will be paying for all damages that have been incurred through the wrongful death claim.
Our Thoughts
It's not pleasant to see an insurance company that swings the blame to those under their own insurance plan in order to save costs.
